Are THC-O Gummies Legal?
THC-O, when derived from hemp, is legal on a federal level. This is because the 2018 Farm Bill legalized hemp and hemp-derived cannabinoids. Hemp is cannabis with a 0.3% or lower concentration of Delta-9 THC by dry weight.
THC-O is an entirely different cannabinoid from Delta-9 THC. Although Delta-9 is legal in compliant concentrations, THC-O does not have any concentration limits (as of this writing).
However, federal legality does not mean national legality. It only allows for hemp-derived cannabinoids to be shipped across state lines and that federal law enforcement won't go after it.
States can make their own laws on hemp-derived cannabinoids. Some states allow for THC-O from hemp to be sold and possessed, while others might ban it. So check your state laws first before you buy THC-O gummies.
