Unlike Delta-9 THC, the concentration levels of Delta-8 THC in a product on a dry-weight basis are not federally regulated. Therefore, various forms of Delta-8 THC (such as gummies, tinctures, capsules, and edibles) can be legally purchased by adults 21 and older in most states. However, some state governments have enacted independent bans on all Delta-8 THC products, so before purchasing Delta-8 products, check in with your state laws first.

Drug tests are designed to detect metabolites, specifically those produced by your body after consuming THC. Although hemp-derived Delta-8 is legal on a federal level, a drug test will not show whether metabolites were used to break down Delta-8 THC from hemp or Delta-8 THC from marijuana. Therefore, it is best to avoid consuming any products containing hemp-derived cannabinoids if there's a drug test in the near future.
