Is Delta 9 THC Legal in Virginia?

Most people have questions when it comes to the legality of hemp products. One of the most common questions we see here at Hometown Hero is—is Delta-9 THC legal in Virginia?

To give you the short answer, yes! As you probably already know, the 2018 Farm Bill federally legalized the production of hemp. This means that as of August 9, 2021, all cannabinoids and products that derive from hemp, including CBD, Delta 8, and Delta 9, are federally legal.

Virginia followed suit and legalized Delta-9 THC when they legalized hemp on March 21, 2019. Hemp is cannabis with a 0.3% or less concentration of Delta-9 THC on a dry weight basis.

In April 2021, Governor Northam and Virginia’s General Assembly passed bills HB2312 and SB1406 that eliminated criminal penalties for simple possession of marijuana.

Here are some highlights of the enactments:

SUMMARY AS ENACTED WITH GOVERNOR'S RECOMMENDATION:

Marijuana; legalization; retail sales; penalties. Eliminates criminal penalties for simple possession of up to one ounce of marijuana by persons 21 years of age or older, modifies several other criminal penalties related to marijuana, and imposes limits on dissemination of criminal history record information related to certain marijuana offenses.

Legal Specifications:

“Adults 21 years and older may possess not more than one ounce of cannabis for personal use.”

“Generally, adults 21 years and older may use marijuana in private residences. However, nothing prohibits the owner of a private residence from restricting the use of marijuana on its premises.”

“It remains illegal for anyone to possess more than one ounce of marijuana.”

“It remains illegal to distribute or sell marijuana, and/or to possess any amount of marijuana with the intent to distribute or sell it. This prohibition applies equally to businesses, which will not be permitted to sell, “gift,” or in any other way distribute marijuana.”

What’s Delta-9 THC?

The hemp plant is quite complex. In fact, there are over 113 cannabinoids that can be extracted from the plant. One of these many constituents includes Delta 9 THC (Delta-9-tetrahydrocannabinol). This cannabinoid can be found in both hemp and marijuana.

So how do we get CBD, Delta 9 THC, and other cannabinoids from a hemp plant? The answer is CO2 extraction. This method utilizes pressurized carbon dioxide to extract distinct cannabinoids from the hemp plant, some of the most popular being CBD, Delta-8, and blends containing Delta-9.

CO2 extraction is used by Hometown Hero simply because we stand by using safe and clean methods to extract natural cannabinoids from hemp. This way, our customers know they are receiving only high-quality products to enjoy.

What Are the Effects of Delta 9 THC?

While different cannabinoids have varying effects, most cannabis enthusiasts say that Delta 9 brings on feelings of:

  • Relaxation
  • Calmness
  • Euphoria
  • Laughter

At the end of the day, THC affects everyone differently. Made for the entourage effect, Select Spectrum contains CBD, Delta-9, and other cannabinoids. At Hometown Hero, we recommend starting small. Begin with a smaller amount and increase it as needed.

Can You Buy Delta-9 in Virginia?

Buying Delta-9 in Virginia is easy! If you are above the age of 21, you can legally purchase Delta 9 THC. You may have even purchased it already if you’ve ever bought full-spectrum CBD products.

If you didn’t know, Delta 9 could be purchased in Virginia even before they permitted the sale of marijuana. As of August 9, 2021, you most likely won’t be finding a dispensary just yet. However, since it’s not considered “weed”, you can legally purchase hemp-derived Delta 9 THC. Many people opt to buy Delta 9 products online in Virginia.

What’s the Difference Between Delta-8 and Delta-9

Upon finding out that there are over 113 cannabinoids that can be extracted from hemp, you may be curious about some of the different effects. Here we will explain the differences between two of the most popular constituents— Delta 8 and Delta 9.

While both are forms of THC and have similar chemical makeups, the main difference is in the molecular arrangement. To put it in simple terms: Delta 9 has a chemical bond on the ninth carbon chain, while Delta 8 has a chemical bond on the eighth carbon chain.

It doesn’t seem like much, but these differences are what cause varying effects on the body. Those who have consumed Delta 9 have reported feelings of euphoria, laughter, and relaxation. Delta 8’s properties are comparable but with different effects.

Is Delta-9 Safe?

Generally, Delta-9 is safe. However, each person may experience varying effects, so we recommend starting small. After all, moderation is essential in just about anything.

After you consume hemp products that contain THC, do not operate a vehicle or machinery. Keep in mind that THC does affect everyone a bit differently, and while there is no physical danger to worry about, some may feel a bit “overwhelmed”.

If you think you may have consumed too much, we recommend finding an activity to ease your mind. Some ideas include listening to music, drawing, reading, or exercising.
