Is Delta 9 THC Legal to Buy in New Jersey?

Most know that the 2018 Farm Bill legalized the production of hemp. But does that leave you wondering—is Delta-9 THC legal in New Jersey?

Yes! Delta 9 is legal in New Jersey. As of this writing, all cannabinoids and hemp-derived products such as CBD, Delta 8, and Delta 9 are federally legal under the Farm Bill. By definition, hemp has a Delta 9 THC concentration of 0.3% or lower on a dry weight basis.

New Jersey has also taken it one step further and legalized recreational marijuana use for adults 21 years of age or older. This means you can purchase any cannabis product, including those that are hemp-derived and contain Delta 9 THC.

The difference between hemp and marijuana is simple. Hemp contains THC concentrations of 0.3% or less on a dry weight basis. Conversely, marijuana contains more than 0.3% THC concentrations on a dry weight basis.

Here, we will take a look at New Jersey’s Hemp Program Summary and Rules:

New Jersey Hemp Program

N.J.A.C. 2:25-1 et seq.

Summary

The New Jersey Department of Agriculture (“Department”) has adopted new rules governing the New Jersey Hemp Farming Act (“Act”) to license and promote the cultivation of industrial hemp at N.J.A.C. 2:25-1 et seq.

The cultivation of industrial hemp for research purposes was initially authorized in the N.J.A.C. 2:25-1 et seq. as of Feb. 3, 2020. Changes to laws or regulations may occur. 1 Agriculture Act of 2014, 7 U.S.C. § 5940, “Legitimacy of Industrial Hemp Research.” The law distinguished hemp from marijuana by defining it as “the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of no more than 0.3 percent on a dry weight basis.”

2:25-1.2 Definitions

“Cannabis” means a genus of flowering plants in the family Cannabaceae of which Cannabis sativa is a species, and Cannabis indica and Cannabis ruderalis are subspecies thereof. Cannabis refers to any form of the plant in which the delta-9 tetrahydrocannabinol concentration on a dry weight basis has not yet been determined.

“CBD” or “cannabidiol” is a phytocannabinoid found in cannabis, which does not produce psychoactive effects in users.

“Hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof, and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis. Hemp and hemp-derived cannabinoids, including cannabidiol, shall be considered an agricultural commodity and not a controlled substance due to the presence of hemp or hemp-derived cannabinoids.

“Hemp extract” means the oil chemically extracted from hemp’s aerial plant part, such as seeds, stalks, or flowers, using chemical processes, containing a natural blend of phytocannabinoids, and includes cannabidiol, or “CBD” oil.

“Hemp product” means a finished product with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent that is derived from or made by processing a hemp plant or plant part and prepared in a form available for commercial sale.

What’s Delta-9 THC?

Research shows that over 113 cannabinoids can be extracted from the composite hemp plant. Among the most popular constituents are Delta 9, Delta 8, and CBD (cannabidiol).

It used to be only associated with marijuana; however, Delta-9 THC (Delta-9-tetrahydrocannabinol) is found in both hemp and marijuana plants.

At Hometown Hero, we only use Delta-9 that has been derived from hemp and at a concentration no greater than 0.3% by dry weight.

What Are the Effects of Delta 9 THC?

As we know, cannabinoids can have a number of effects, each varying a little bit. For example, most cannabis connoisseurs have reported that Delta 9 edibles brings on feelings of:

  • Euphoria
  • Calmness
  • Relaxation

Keep in mind that THC affects each individual differently. If you are trying hemp-derived Delta-9  for the first time, we recommend starting out small. You can always increase the amount if you would like but you can’t “go back.”

What’s the Difference Between Delta-8 and Delta-9

Now that you know that over 113 cannabinoids can be extracted from hemp plants, you are probably wondering about the different effects. Good news—you’ve come to the right place. Here we will break down the differences between two out of the most sought after cannabinoids: Delta 8 and Delta 9.

Both of these constituents are forms of THC and have similar chemical compositions. However, the molecular arrangement is different. Without getting too complicated, Delta 9 has a chemical bond on the ninth carbon chain, and Delta 8 has a chemical bond on the eighth carbon chain.

You may be wondering—what’s the difference? We know it doesn’t seem like much, but this is what causes different effects on the body. Delta 9 consumers have reported feelings of relaxation, euphoria, and calmness. The properties of Delta 8 are similar in some ways but with different effects.
