Is Delta 9 Legal in Illinois?

Is Delta 9 THC Legal in Illinois?

Most people are aware that the 2018 Farm Bill federally legalized the production of hemp. But perhaps this leaves you wondering—is Delta 9 THC legal in Illinois as well?

To quickly sum it up, yes! As of this writing, all cannabinoids and products that derive from hemp, including CBD, Delta 8, and Delta 9 are federally legal. 

As a matter of fact, since June 2020, recreational marijuana has been legal in Illinois as well. This means that you can legally purchase cannabis products, which includes any of those containing Delta 9 THC.

    Sec. 1-10. Definitions in this Act:

"Cannabis" means marijuana, hashish, and other substances that are identified as including any parts of the plant Cannabis sativa and including derivatives or subspecies, such as indica, of all strains of cannabis, whether growing or not; the seeds thereof, the resin extracted from any part of the plant; and any compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or resin, including tetrahydrocannabinol (THC) and all other naturally produced cannabinol derivatives, whether produced directly or indirectly by extraction.

    Sec. 1-5. Findings (a).

    (a) In the interest of allowing law enforcement to focus on violent and property crimes, generating revenue for education, substance abuse prevention and treatment, freeing public resources to invest in communities and other public purposes, and individual freedom, the General Assembly finds and declares that the use of cannabis should be legal for persons 21 years of age or older and should be taxed in a manner similar to alcohol.
