As of today 09/21/2021, Delta 8 THC is legal according to Louisiana state law. Like the federal law, Louisiana has legalized all derivatives, cannabinoids, and isomers of hemp including all tetrahydrocannabinols other than Delta 9 THC.
Much in the same vein as Delta 8 THC in Texas, Louisiana has also taken a kinder approach to it's hemp regulations.
The laws follow:
§1462. Definitions
(10) “Industrial hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol (THC) concentration of not more 0.3 percent on a dry weight basis.
§961. Definitions
§961.1. Industrial hemp exemption
Notwithstanding the definitions provided for in R.S. 40:961(6) and (26), the provisions of the Uniform Controlled Dangerous Substances Law shall not apply to industrial hemp or industrial hemp-derived CBD products as provided for in Parts V and VI of Chapter 10-A of Title 3 of the Louisiana Revised Statutes of 1950. (27) Tetrahydrocannabinols, including synthetic equivalents and derivatives, except for tetrahydrocannabinols in hemp
As of August 1st, Gov. John Bel Edwards had signed a law into place that expands medical marijuana to any patient where the doctors see fit to combat any debilitating conditions. Other measures signed into place were legislation to protect banks and credit units that service cannabis businesses from being penalized by any state regulators and a bill to provide any legal protections for doctors who recommend medical marijuana to their patients.
Of course! After the 2018 Farm bill federally legalized hemp, it opened up the door for other states to establish their own laws on hemp. Fast-forward today, a majority of states have legalized the sale of hemp products, including Louisiana.
As of September X, 2021, all cannabinoids and derivatives of hemp are legal and available for purchase for those who are 21 years or older. Currently, there are no concentration limits on Delta 8 THC or CBD, but like federal law, there is for hemp-derived Delta-9. According to federal and state law, a hemp product can contain 0.3% of Delta 9 or less on a dry weight basis.
